Our Data Recovery Services Confidentiality Guarantee
THIS GUARANTEE governs the safeguarding and the confidentiality of “Customer’s” data.
1. Definition Of Confidential Information
As used herein, “Confidential Information” shall mean any and all technical and non-technical information related to the extracted data, including but not limited to (a) patent(s) and patent applications, (b) trade secret, and (c) copyrighted information (d) personal and private information including email, word documents and excel files (e) proprietary information– ideas, techniques, sketches, drawings, works of authorship, models, inventions, know-how, processes, apparatuses, equipment, algorithms, software programs, software source documents, and formulae related to the current, future, and proposed products and services of the “Data Recovery Customer”, and including, without limitation, the “Data Recovery Customer’s” respective data concerning research, experimental work, development, design details and specifications, engineering, financial information, procurement requirements, purchasing, manufacturing, customer lists, investors, employees, business and contractual relationships, business forecasts, sales and merchandising, marketing plans and information the “Customer” provides regarding third parties.
2. Handling Of Confidential Information
Data Savers Pte Ltd agrees that at all times it will hold in strict confidence and not disclose to any third party Confidential Data of the “Data Recovery Customer”, except as approved in writing by the “Data Recovery Customer”, and will use the Confidential Information for no purpose other than data recovery. Data Savers Pte Ltd shall only permit access to Confidential Data of the “Data Recovery Customer” to those of its data recovery employees or authorized representatives having a need to know and who have signed confidentiality agreements or are otherwise bound by confidentiality obligations at least as restrictive as those contained herein.
We treat our customer’s data with the highest level of confidentiality.
Our recovery process is implemented in such a way that only the customers themselves will verify that the recovered data is good for acceptance.
All incoming data recovery jobs by default will follow our strict in-house non-disclosure agreement (NDA).
You warrant that you are the legal owner or the authorized representative of the legal owner of the device, media, and data. You warrant that that the data on your device is legal and that you have the unrestricted legal right (a) to send us the device, media, and data; (b) to have the data recovered using the Services; (c) to receive the recovered data; and (d) to agree to these Terms. You will defend and indemnify us (including our directors, officers, employees, and contractors) from any claims or actions relating to the device, media, or data, or your rights or lack of rights thereto.
